Uh not again......what's going on with Quick Response Outsourcing?















It's been a while....

I have been busy lately and thought I would take a break and update a few blogs. Uh here we go.

Five months had passed since her pay began to be delayed and 90 days since her health insurance had lapsed.

Still, Julia Cardenas was getting ready for a job that she says hadn't paid her at all in weeks.

That Monday morning after the July Fourth holiday, she says her boss called to say not to bother coming into work. Her job was gone. And her employer, C4 Direct Solutions in Pompano Beach, had shut down.

Cardenas is one of at least a dozen former employees at the administrative outsourcing firm who say they were owed thousands of dollars in back pay or uncovered medical bills when the company folded.

They're part of a growing group of jobless who endure a more protracted form of misery in today's tough economy: lapsed health coverage, bounced paychecks, and finally, no pay at all.

U.S. Department of Labor spokesman Mike D'Aquino says the department doesn't collect data on the number of cases in which employees are owed wages. But, he says, such violations seem to be on the rise.

The Department recently announced it would add 250 investigators nationwide over the next two years in an effort to step up enforcement.

Federal law affords employees strong protections to recover unpaid wages, and those who have sought legal counsel say they're optimistic about receiving back pay. But it becomes more difficult if a company declares bankruptcy or has no assets.

At a Fuddruckers in Wellington this spring, roughly 40 employees were stiffed on two weeks of pay after owners shuttered the franchise and prepared to file for bankruptcy. They told The Palm Beach Post that there was simply no money to pay -- devastating news for workers like Charles Obee, a cook with a fiancée and a 2 year-old son to support. Shortly after his story appeared, the owners paid $12,000 in back wages.

FILING SUIT

But beyond putting pressure on an employer, workers can file suit. The Fair Labor Standards Act allows workers to sue for back pay to recover double the minimum wage for normal and overtime hours.

Miami labor attorney Kevin Mercer says for those who earn more than the minimum wage, the difference between minimum and promised wage can be recouped through a suit in state court. But he said the difference is often paid in the federal settlement to avoid further litigation.

Plaintiffs are also allowed to sue company owners to recover unpaid wages -- a practice normally not allowed in civil cases. And the statute provides for ``a reasonable attorney's fee'' to be paid by employers found in violation.

Mercer, who has filed Fair Labor cases for four C4 Direct employees, says he has seen requests for representation in cases like this grow as the economy has weakened.

Former C4 Direct employees say the trouble began in February, when Friday paydays became Saturdays. Next, the funds dried up, checks began bouncing, and Monday mornings became a desperate race to the bank.

``On Monday, everyone would go to the Wachovia at 7:45 so they could be the first one to cash their check,'' said Gilberta Fergile. ``It would maybe be five that could, and the rest would have to get their money during the week.''

By June, the employees say, the checks had simply stopped coming. Several eventually quit, tired of toiling for no apparent compensation. Those who stuck around saw the Pompano Beach location close in early July.

`A SIGN OF THE TIMES'

C4 owner Ron Thibeau says his company fell prey to delinquent clients and bank fraud that drained company accounts. He says he is working to liquidate the company and has already paid some employees back, but he adds it will take weeks to meet the obligations.

Thibeau says he is working with a lawyer to file bankruptcy and hopes to have everyone paid in the next couple months.

``The unfortunate thing is we are a sign of the times. I'm not the only company that is going through these things,'' Thibeau said. ``I am still . . . doing everything I can to finalize all of the payrolls.''

Four C4 managers set up their own call center firm, agreeing to take some of C4's equipment for payments owed, according to Thibeau.

Several C4 employees say they held on without pay because their prospects in the job market seemed so slim with the unemployment rate in Broward County at its highest in 17 years. Now jobless, most say they desperately need the earnings.

Cardenas, who kept working after many of the employees left, says she was shocked when she heard her job had simply evaporated.

``It was such a last-minute thing. They called me an hour prior to when I had to be at work,'' Cardenas said. ``I asked . . . `So that's it? You're not gonna give me any options?' ''

Employees can also recover wages by filing a complaint with the Department of Labor, which investigates and enforces minimum wage claims for standard or overtime hours free of charge. They run a toll-free helpline for such complaints at 1-866-4USWAGE.

Even with the strong employee protections that exist under the law, Mercer says that, paradoxically, the number of suits he has filed has dropped because many delinquent employers are in such dire financial condition that there is nothing to recover in court.

"The attorney relies on the solvency of the defendant in order to get paid,'' Mercer says. ``With the economy struggling the way it is . . . I've turned more cases away over the last six months than I did over the previous years for precisely that reason.''

C4 direct has not only screwed me over but along with approximately 30 other people. Around February 2009 we were told that the company was going thru some issues that we needed to be supportive for and 'stick it out' . In a days notice they cut our paycheck in half for one week, meaning we got half of a check this week and the remainder the next. Is that legal? I'm not sure. At that point we were now behind 3 checks instead of the original 2.

After that happened, that's when it started going down hill. I could never cash my checks at the bank because it was reported that C4 Direct Solutions did not have any funds in the account. If I went to a check cashing place, I would succesfully cash it, (if they didn't klnow about the company) yet the following week I would recieve a call saying I owed money for the bounced check I provided.

Ron, the owner of C4 reported that we would get over this by May. It was now June. Two saturdays passed (we got paid every week) and we did not recieve a check. Their excuse? 'The checks will be here tomorrow' About two days later Ron called some people into the confrence room stating that we would recieve a pay roll cut. And if we refused the pay roll cut they would lay us off. Not happy with my options, I decided to be laid off because I was sick of their nonsense! They said they would send my checks in the mail and I should recieve them shortly. Weeks passed and I did not recieve ANYTHING! Furious, I called HR and she had no idea what was going on. As well as another supervisor Raul Valencia. How do you not know what is going on with my money? keep in mind they now owe me 5 checks because of the three they held back originally and two that I didnt recieve while working there.

I'm only 17 and I know I don't have a lot of bills to pay, but I am not not going to do anything about it. They owe me approximately $2,000 and i could imagine how much they owe the poeple that were getting paid way more than me. They also have taken out insurance on checks for some people yet they really didn't have any. Why are you decucting money when the poeple did not have insurance. Now they dont only have to pay for the hours we've worked, but as well as unpaid medical bills.

As for that, they have now changed their name to Quick Response Out Sourcing. The employees working there are getting paid so why not pay your former employees? A team of us has gathered and we are working on a way to sue this company so we can ALL get our money. Ron is in serious debt. And all I have to say is.. see you in court!!!!!

My cousin and I worked for this company back in 2005. We experienced some similar things as other reports. Since reading these other complaints we now know that we were being treated unfairly intentionally. We experienced working in no A/C for days while management was conveniently on vacation and lied to us for several days that a technician was supposed to come fix the air. We were haggled every day about everything from break times, to not ordering food that had to be delivered, to what we can and can't drink on break even thought the drink machine was stocked with bottles. There suddenly became a no bottle rule in the break room but management

was allowed to purchase them from the machine. However, once the A/C situation arose we complained everyday about working in constant heat until management called us in and fired us. We were due to receive several paychecks and was told our checks would be mailed to us. However after weeks of calling and asking about our check they attempted to have no recollection of us being owed any money. At the time we found it easier to just let it go but just because this company is still in business we would like to recover our money. So if there is anyone who gets a class action suit we would definitely join the fight. It is not right how they treat their employees and knowingly withhold their wages for their own salaries.
